Butler County Prosecutor announced today the successful prosecution of dangerous criminals

(Hamilton, Ohio) The Butler County Prosecutor announced today the successful prosecution of dangerous criminals. Gabriel Tyrone Smith was convicted of Felonious Assault, a Gun Specification, and was labeled a Repeat Violent Offender. Judge Sage immediately sentenced him to 21 years in prison. Shadeed Barnett was convicted of Felonious Assault and a Gun Specification, and Judge Sage immediately gave him the maximum sentence of 11 years. Teray Marshall was convicted of Felonious Assault and a Gun Specification, and and Judge Sage immediately gave him the maximum sentence of 11 years.

On September 19, at 3:30 a.m., the Middletown South Main Projects erupted in gunfire. Four people were injured, one of which was Demarco Conley who is still in the hospital with a gunshot wound to the stomach. Mr. Conley’s injures remain life-threatening.

Mr. Conley testified via videotape deposition from the hospital and was corroborated by over a dozen of eyewitnesses. One female witness testified that she was awakened to her 2 year old girl crying and automatic gunfire hitting her home. She grabbed her daughter and got to the ground to hear men screaming and see shots fly from a Blue Taurus. Other witnesses were able to identify Teray Marshall, Shadeed Barnett, and Tyrone Smith firing at, and striking, other victims.

Middletown Detectives and a Miami Valley Crime Lab Expert testified that at least 4 guns were used. Shell casings and bullets were recovered from the ground and neighboring apartments matching other evidence the police had gathered. After 4 days of testimony and nearly 20 witnesses, the jury reached a verdict after 11 hours of deliberation.

Prosecutor Piper stated, “This rag-tag gang has terrorized parts of Middletown long enough. Their disregard for others has resulted in permanently maiming a young man who will be paralyzed the rest of his life, hounded by serious complications. With these convictions today, these violent offenders have anointed themselves as messengers to others in the community that guns and violence will only result in very lengthy prison sentences.”

“We applaud the work of the Middletown Police Department and deeply appreciate the jury’s hard work in putting all of the evidence together. The Middletown Police have been working hard to sweep violent offenders off of the streets and these important verdicts today give hope and momentum,” Piper concluded.
