Scott O. Brown Found Guilty Possession of Cocaine and Soliciting

Scott O. Brown, 41, of Ripley, Ohio, was found guilty of two felony counts of possession of cocaine and soliciting, following a bench trial in front of Judge Noah Powers on Monday, March 9, 2009. Brown had rented a room at the American Best Value Inn in Fairfield on July 31, 2008. He and two male friends agreed to pay a 20 year old female for sex.

Two Fairfield Police officers heard suspicious activity consistent with drug usage coming from the hotel room. As one officer knocked at the door, the other officer observed through a window as the occupants attempted to conceal drugs. When confronted by the police, the occupants denied any drugs, but crack cocaine, pipes and other paraphernalia were found by the police.

A videotape taken by one of the men showed Brown passing a crack pipe to another of the men, as well as depicting sexual conduct between the woman and Brown.

Brown was fully clothed when the officers arrived; however, the officer outside saw Brown remove his clothes and get in the hot tub before they opened the door. Brown argued through counsel, at trial, that he could not be found guilty of possession of cocaine because it was not on him.

Judge Powers dispelled that argument, finding the videotape sufficient evidence that Brown possessed or used crack cocaine, and Brown, if not actually then, constructively possessed the half gram of crack found in the hotel room.

Detective Kevin Mack investigated the case for the Fairfield Police Department and the State was represented by assistant prosecuting attorney, John Heinkel.

Judge Powers has scheduled sentencing for April 14, 2009. Brown faces up to two years in prison and $5000 in fines following his conviction.
