38-Yeard Old Franklin Indicted In Death of Pedestrian

The Butler County Prosecutor’s Office announced today that Curtis Ward was indicted on Aggravated Vehicular Homicide and two counts of Operating a Vehicle under the Influence.

The Defendant will be arraigned on Wednesday, June 23, 2010, before Judge Andy Nastoff. The Defendant is 38 years old and lives in Franklin, Ohio. The Defendant has prior convictions for Using Weapons while intoxicated, Reckless Operation, and two prior OVI’s.

On June 19, 2010, at about 7:30 p.m. the Defendant was traveling West bound on St. Rt. 63 when he struck and killed 23 year-old Stacy Moermond while the victim was standing off the roadway. The victim was transported to Miami Valley Hospital and was pronounced dead as a result of severe head and body trauma. The Defendant admitted to driving the vehicle that struck the victim, and he had a BAC level of .130.

Assistant Prosecutor Jason Phillabaum stated, “Originally, the Area Court Judge set Ward’s bond at $55,000, but a few days later, a magistrate reduced the bond to $2,000 ($20,000 at 10%), and the Defendant was released. In order to protect the public, I presented the case to the Grand Jury so a Common Pleas Court can determine if this is the kind of individual we really want out on the streets. He obviously continues to drink and drive, and now he has killed someone. It is a tragedy that a young man is dead because Ward insists on driving while drunk. Things like this should never happen. It is a strong case, and we will prosecute to the fullest extent, but it is sad that nothing will bring back this young man.”

The preliminary hearing, scheduled for today at 1:00 p.m. in Area 3 Court, will be cancelled due to the indictment being issued direct by the Grand Jury. The defendant faces a mandatory sentence of 2-8 years in prison if convicted.
